THE CHITTAGONG HILL-TRACTS AERIAL ROPEWAYS REGULATION, 1960

A REGULATION to apply the Bengal Aerial Ropeways Act, 1923 , to the Chittagong Hill-tracts. WHEREAS it is expedient to apply the Bengal Aerial Ropeways Act, 1923 , to the Chittagong Hill-tracts; NOW, THEREFORE, in pursuance of the Presidential Procalmation of the seventh day of October, 1958, and in exercise of all powers enabling him in that behalf, the 1[Government] is pleased to make the following Regulation, namely:- Short title and commencement 1. (1) This Regulation may be called the Chittagong Hill- tracts Aerial Ropeways Regulation, 1960. (2) It shall come into force at once

Application of Ben. Act VII of 1923 to the Chittagong Hill- tracts 2. The Bengal Aerial Ropeways Act, 1923 (hereinafter referred to as the said Act), and the rules made thereunder shall, subject to the following amendments, apply to the Chittagong Hill-tracts, namely: Amendments Amendment of the long title and the preamble 1. In the long title and the preamble of the said Act, for the word "Bengal" occurring twice, the words 1 [ Bangladesh ] shall be subtituted . Amendment of section 1 of the Ben. Act VII of 1923 2. Sub-sections (2) and (3) of section 1 of the said Act shall be omitted .

Amendment of section 2 of the Ben. Act VII of 1923 3. In section 2 of the said Act,- (a) in clause (1) for the words "an aerial ropeway", the words "an aerial ropeway or overhead monorail crane" shall be substituted; (b) for clause (3), the following shall be substituted, namely:- "(3) “Deputy Commissioner” means the Deputy Commissioner of the Chittagong Hill-tracts and includes any officer specially appointed by the 1 [Government] to discharge the functions of a Deputy Commissioner under this Regulation;"; (c) for sub-clause (iv) of clause (9), the following shall be substituted , namely:- " (iv) any company incorporated under the Companies Act, 1913."; and (d) sub-clause (v) of clause (9) shall be omitted .

Amendment of section 5 of Ben. Act VII of 1923 4. In section 5 of the said Act, for the words, figures and commas "and of section 4 of the Land Acquisition Act, 1894,", the words, figures and commas "and of section 3 of Chittagong Hill-tracts (Land Acquisition) Regulation, 1958 ' href='/act-1363.html'>THE Chittagong Hill-tracts (Land Acquisition) Regulation, 1958 ," shall be substituted.

Amendment of section 6 of Ben. Act VII of 1923 5. In clause (vii) of sub-section (6) of the said Act, the words "the Federal Railway Authority or" shall be omitted.

Amendment of section 12 of Ben. Act VII of 1923 6. In section 12 of the said Act, for the words "Indian Penal Code", the words " 1 [***] Penal Code" shall be substituted.

Amendment of section 14 of Ben. Act VII of 1923 7. In section 14 of the said Act, for the word "Collector" occurring twice, the words "Deputy Commissioner" shall be substituted.

Amendment of section 15 of Ben. Act VII of 1923 8. In sub-section (2) of section 15 of the said Act, for the word "Collector", the words "Deputy Commissioner" shall be substituted.

Amendment of section 16 of Ben. Act VII of 1923 9. In section 16 of the said Act, for the words "Collector" occurring thrice, the words "Deputy Commissioner" shall be substituted.

Amendment of section 17 of Ben. Act VII of 1923 10. In section 17 of the said Act,- (a) for the word "Collector" occurring twice, the words "Deputy Commissioner" shall be substituted; and (b) for the words "District Judge", the words "Commissioner of Chittagong Division" shall be subtituted.

Amendment of section 20 of Ben. Act VII of 1923 11. In clause (a) of section 20 of the said Act, for the words "Indian Penal Code", the words" 1 [***] Penal Code" shall be substituted.

Amendment of section 26 of Ben. Act VII of 1923 12. In sub-section (2) of section 26 of the said Act, the words, figures and commas "notwithstanding anything contained in the Provincial Insolvency Act, 1920," shall be omitted.

Amendment of section 28 of Ben. Act VII of 1923 13. In sub-section (1) of section 28 of the said Act, for the words, figures and commas "of Part VII of the Land Acquisition Act, 1894, or procure the temporary occupation of the same under the provisions of Part VI of the said Act, whether the said promoter is or is not a company as defined in that Act", the words, figures and commas "of Chittagong Hill-tracts (Land Acquisition) Regulation, 1958 ' href='/act-1363.html'>THE Chittagong Hill-tracts (Land Acquisition) Regulation, 1958 " shall be substituted.

Amendment of section 30 of Ben. Act VII of 1923 14. Section 30 of the said Act shall be omitted.

Amendment of section 33 of Ben. Act VII of 1923 15. In clause (c) of section 33 of the said Act, for the words "Indian Penal Code", the words" 1 [***] Penal Code" shall be substituted.

Amendment of section 34 of Ben. Act VII of 1923 16. In section 34 of the said Act, for the words "Indian Penal Code", the words" 1 [***] Penal Code" shall be substituted.

Amendment of section 38 of Ben. Act VII of 1923 17. In section 38 of the said Act, for the words, figures and commas "of the Land Acquisition Act, 1894", the words, figures and commas "of Chittagong Hill-tracts (Land Acquisition) Regulation, 1958 ' href='/act-1363.html'>THE Chittagong Hill-tracts (Land Acquisition) Regulation, 1958 ," shall be substituted.
